Based on a person&#8217;s controlling investment in the United States, permits them to work there. People with different types of visa who are already in the country may be able to apply to modify their status to E-2.<\/p>\n<p><span style=\"font-weight: 400;\">This is the second entry of a <strong><a href=\"https:\/\/lukebowmanlaw.com\/lawblog\/?s=E-2+visa\">5 part blog series<\/a> <\/strong>depicting the various classifications of this visa to help you identify whether the E-2 Treaty Investor visa might be the right fit for you.<\/span><\/p>\n<h2>E-2 Classification as a Specialized\/Essential Employee<\/h2>\n<p><span style=\"font-weight: 400;\">To qualify for E-2 classification as a Specialized\/Essential Employee, the employee must:<\/span><\/p>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li><span style=\"font-weight: 400;\">Be the same nationality as the principal alien employer (who must have the nationality of the treaty country);<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Meet the definition of \u201cemployee\u201d under relevant law; and<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Be either engaging in duties of an executive or supervisory position or if employed in a lesser capacity, have special qualifications.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Either be engaging in duties of an executive or supervisory character or if employed in a lesser capacity, have special qualifications.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-535\" src=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E-2-Classification-as-a-Specialized-Essential-Employee.jpg\" alt=\"E-2 Classification as a Specialized\/Essential Employee\" width=\"1920\" height=\"1280\" srcset=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E-2-Classification-as-a-Specialized-Essential-Employee.jpg 1920w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E-2-Classification-as-a-Specialized-Essential-Employee-300x200.jpg 300w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E-2-Classification-as-a-Specialized-Essential-Employee-1024x683.jpg 1024w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E-2-Classification-as-a-Specialized-Essential-Employee-768x512.jpg 768w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E-2-Classification-as-a-Specialized-Essential-Employee-1536x1024.jpg 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">More specifically this classification requires the specialized\/essential employee to be <\/span><span style=\"font-weight: 400;\">able to demonstrate that they possess the specialized skill set that makes the service to be rendered essential to the efficient operation of the treaty enterprise;<\/span><\/p>\n<h3><strong>What constitutes specialized skills?\u00a0<\/strong><\/h3>\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">(1)\u00a0 <\/span> <span style=\"font-weight: 400;\">In assessing the specialized nature of the skills sought and whether the applicant possesses these skills, consider the following:<\/span><\/p>\n<p style=\"padding-left: 80px;\"><span style=\"font-weight: 400;\">(a)\u00a0 The experience and training necessary to achieve such skill(s);<\/span><\/p>\n<p style=\"padding-left: 80px;\"><span style=\"font-weight: 400;\">(b)\u00a0 The uniqueness of such skills;<\/span><\/p>\n<p style=\"padding-left: 80px;\"><span style=\"font-weight: 400;\">(c)\u00a0 The availability of U.S. workers with such skills;<\/span><\/p>\n<p style=\"padding-left: 80px;\"><span style=\"font-weight: 400;\">(d)\u00a0 The salary such special expertise can command;<\/span><\/p>\n<p style=\"padding-left: 80px;\"><span style=\"font-weight: 400;\">(e)\u00a0 The degree of proven expertise of the applicant in the area of specialization; and<\/span><\/p>\n<p style=\"padding-left: 80px;\"><span style=\"font-weight: 400;\">(f)\u00a0\u00a0 The function of the job to which the applicant is destined.<\/span><\/p>\n<h3>What is the expected duration of the employee\u2019s essentiality?<\/h3>\n<ol>\n<li><span style=\"font-weight: 400;\">The applicant bears the burden of establishing at the time of the application not only that they<\/span><i><span style=\"font-weight: 400;\">\u00a0<\/span><\/i><span style=\"font-weight: 400;\">possess the requisite specialized skills but, also, the length of time that such skills will be needed.\u00a0<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\"><strong>Family<\/strong>&#8211; The family of E-2 Treaty Investors and Employees may be accompanied or followed by spouses and unmarried children who are under 21 years of age.\u00a0 Their nationalities need not be the same as the treaty investor or employee.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Period of Stay<\/strong>&#8211; Qualified treaty investors and employees will be allowed a maximum initial stay of 2 years. Requests for an extension of stay may be granted in increments of up to 2 years.
