{"id":516,"date":"2022-10-01T00:11:42","date_gmt":"2022-09-30T18:41:42","guid":{"rendered":"https:\/\/lukebowmanlaw.com\/lawblog\/?p=516"},"modified":"2026-01-22T22:20:04","modified_gmt":"2026-01-22T16:50:04","slug":"what-is-the-meaning-of-e-2-visa","status":"publish","type":"post","link":"https:\/\/lukebowmanlaw.com\/lawblog\/what-is-the-meaning-of-e-2-visa\/","title":{"rendered":"What is the meaning of E-2 visa?"},"content":{"rendered":"<h2><b>E-2 visa<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The E-2 visa is a long-term non-immigrant visa that allows foreign nationals investing in a US business to direct and develop the business while living and working in the US<\/span><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\">\u00a0<\/span><span style=\"font-weight: 400;\">The E-2 nonimmigrant classification allows a national of a treaty country to be admitted to the United States when investing a substantial amount of capital in a U.S. business.\u00a0Certain employees of such a person or of a qualifying organization may also be eligible for this classification.<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-525\" src=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/09\/Treaty-Investor.jpg\" alt=\"Treaty Investor\" width=\"1920\" height=\"1280\" srcset=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/09\/Treaty-Investor.jpg 1920w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/09\/Treaty-Investor-300x200.jpg 300w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/09\/Treaty-Investor-1024x683.jpg 1024w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/09\/Treaty-Investor-768x512.jpg 768w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/09\/Treaty-Investor-1536x1024.jpg 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">This is the first entry of a 5 part blog series depicting the various classifications of this visa to <a href=\"https:\/\/lukebowmanlaw.com\/immigration-services\"><strong>help you<\/strong><\/a> identify whether the E-2 Treaty Investor visa might be the right fit for you.<\/span><\/p>\n<h3><b>E-2 Classification as an Employee of a Treaty Investor<\/b><\/h3>\n<h4><span style=\"color: #000080;\"><strong>To qualify for E-2 classification- the employee of a treaty investor must:<\/strong><\/span><\/h4>\n<ul>\n<li><span style=\"font-weight: 400;\">Be the same nationality as the principal alien employer (who must have the nationality of the treaty country);<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Meet the definition of \u201cemployee\u201d under relevant law; and<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Be either engaging in duties of an executive or supervisory position or if employed in a lesser capacity, have special qualifications.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">More specifically, <\/span><span style=\"font-weight: 400;\">an E-2 applicant who seeks to be classified as a manager, executive, or supervisor must demonstrate that he\/she is primarily performing executive or supervisory tasks and has a high degree of responsibility within the organization, as well as control over the entire company or over key functions of the company.\u00a0<\/span><\/p>\n<h4><span style=\"color: #000080;\"><strong>To demonstrate control and responsibility in the E-2 company the applicant submits:<\/strong><\/span><\/h4>\n<ul>\n<li><span style=\"font-weight: 400;\">organizational charts showing the company structure;\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">a job description that illustrates the duties that will be performed;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">a resume that shows the applicant has the requisite expertise and<\/span><\/li>\n<li><span style=\"font-weight: 400;\">a letter from the E-2 company, describing the business, job, and employee qualifications. The job title and salary are good indicators of whether the position will be classified as a supervisory\/executive position.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">specific skills<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The salary that the special qualifications can command<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Family- The family of E-2 Treaty Investors and Employees may be accompanied or followed by spouses and unmarried children who are under 21 years of age.\u00a0 Their nationalities need not be the same as the treaty investor or employee.\u00a0<\/span><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-527\" src=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E2-visa-family.jpg\" alt=\"\" width=\"1920\" height=\"1280\" srcset=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E2-visa-family.jpg 1920w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E2-visa-family-300x200.jpg 300w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E2-visa-family-1024x683.jpg 1024w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E2-visa-family-768x512.jpg 768w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2022\/10\/E2-visa-family-1536x1024.jpg 1536w\" sizes=\"auto, (max-width: 1920px) 100vw, 1920px\" \/><\/p>\n<p><span style=\"font-weight: 400;\">Period of Stay- Qualified treaty investors and employees will be allowed a maximum initial stay of 2 years. Requests for extension of stay may be granted in increments of up to 2 years.
