If so, below are some of the basics regarding the I-485 filing process.<\/p>\r\n\r\n\r\n\r\n<p>An I-485 is an application to register permanent residence or adjust status in the United States. U.S. immigration law permits a temporary visitor to file this application status if the individual lawfully entered the United States and meets certain requirements.\u00a0<\/p>\r\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-370 size-large\" src=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/linkedin-ad-1024x535.png\" alt=\"Luke Bowman Law Services\" width=\"830\" height=\"434\" srcset=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/linkedin-ad-1024x535.png 1024w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/linkedin-ad-300x157.png 300w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/linkedin-ad-768x401.png 768w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/linkedin-ad.png 1200w\" sizes=\"auto, (max-width: 830px) 100vw, 830px\" \/><\/p>\r\n\r\n\r\n\r\n<p>Immigration matters in the US are governed and regulated by the U.S. Citizenship and Immigration Services (USCIS), and you must meet all of the requirements to successfully obtain your Green Card.\u00a0<\/p>\r\n\r\n\r\n\r\n<p>\u00a0There are several categories through which one can become eligible to file and I-485.<\/p>\r\n\r\n\r\n\r\n<ul class=\"wp-block-list\">\r\n<li>Family-based<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<p>U.S. immigration law allows certain aliens\u00a0who are family members of U.S. citizens and lawful permanent residents to become lawful permanent residents (get a Green Card) based on specific family relationships.\u00a0<\/p>\r\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-371 size-full\" src=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/visa-application.jpg\" alt=\"\" width=\"1024\" height=\"683\" srcset=\"https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/visa-application.jpg 1024w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/visa-application-300x200.jpg 300w, https:\/\/lukebowmanlaw.com\/lawblog\/wp-content\/uploads\/2021\/07\/visa-application-768x512.jpg 768w\" sizes=\"auto, (max-width: 1024px) 100vw, 1024px\" \/><\/p>\r\n<p>Other family members eligible to apply for a Green Card are described in the following family \u201cpreference immigrant\u201d categories:<\/p>\r\n\r\n\r\n\r\n\r\n\r\n\r\n\r\n<ul>\r\n<li style=\"list-style-type: none;\">\r\n<ul>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">First preference (F1) &#8211; unmarried sons and daughters (21 years of age and older)\u00a0of U.S. citizens;<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Second preference (F2A) &#8211; Spouses and children (unmarried and under 21 years of age) of lawful permanent residents;<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Second preference (F2B) &#8211; unmarried sons and daughters (21 years of age and older)\u00a0of lawful permanent residents;<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Third preference (F3) &#8211; married sons and daughters of U.S. citizens; and<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Fourth preference (F4) &#8211; Brothers and sisters of U.S. citizens (if the U.S. citizen is 21 years of age and older).<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<li aria-level=\"1\"><span style=\"font-weight: 400;\">Employment-based<\/span><\/li>\r\n<\/ul>\r\n<p style=\"padding-left: 40px;\"><span style=\"font-weight: 400;\">U.S. immigration law provides aliens\u00a0with a variety of ways to become lawful permanent residents (get a Green Card) through employment in the United States. These employment-based (EB) \u201cpreference immigrant\u201d categories include:<\/span><\/p>\r\n<ul>\r\n<li style=\"list-style-type: none;\">\r\n<ul>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/employment-based-immigration-first-preference-eb-1\"><span style=\"font-weight: 400;\">First preference (EB-1)<\/span><\/a><span style=\"font-weight: 400;\">\u00a0\u2013 priority workers<\/span>\r\n<ul>\r\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Aliens with extraordinary ability in the sciences, arts, education, business, or athletics;<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Outstanding professors and researchers; or<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Certain multinational managers and executives.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/employment-based-immigration-second-preference-eb-2\"><span style=\"font-weight: 400;\">Second preference (EB-2)<\/span><\/a><span style=\"font-weight: 400;\">\u00a0\u2013 aliens\u00a0who are members of the professions holding advanced degrees or who have exceptional ability (including requests for national interest waivers).\u00a0<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\/employment-based-immigration-third-preference-eb-3\"><span style=\"font-weight: 400;\">Third preference (EB-3)<\/span><\/a><span style=\"font-weight: 400;\">\u00a0\u2013 skilled workers, professionals, or\u00a0other workers.<\/span><\/li>\r\n<\/ul>\r\n<\/li>\r\n<\/ul>\r\n<ul>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Asylum or refugee<\/span><\/li>\r\n<\/ul>\r\n<p><span style=\"font-weight: 400;\">This category includes people who are granted asylum or refugee status by the US government and they also must fulfill the eligibility requirements requested by the USCIS.\u00a0<\/span><\/p>\r\n<ul>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Special immigrant<\/span><\/li>\r\n<\/ul>\r\n<p><span style=\"font-weight: 400;\">Cuban citizens who apply for permanent residency are categorized as special immigrants.<\/span><\/p>\r\n<ul>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Human trafficking victim<\/span><\/li>\r\n<\/ul>\r\n<p><span style=\"font-weight: 400;\">This category includes victims of human trafficking their family members.<\/span><\/p>\r\n<ul>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Special programs<\/span><\/li>\r\n<\/ul>\r\n<p><span style=\"font-weight: 400;\">People who lived in the United States science 1972 and who kept to the requirements throughout their stay can use Form I-485 under this category.\u00a0<\/span><\/p>\r\n<p><span style=\"font-weight: 400;\">Basic documents are required for the I-485 application.<\/span><\/p>\r\n<ul>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The filing fee of $1.225 for applicants 14 years old and above; $750 for applicants 13 years old and younger<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Form G28 confirming the attorney who will represent you in your I-485 filing<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Form I-485 \u2013 The application to apply for the Green Card<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Two passport size photos of the applicant<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Form I-765 Application for Employment Authorization\u00a0<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Form I-131 Application for Travel Document\u00a0<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A copy of the foreign birth certificate of the candidate\u00a0<\/span><\/li>\r\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Copy of your most recent I-94, passport, and previous I-797 approvals<\/span><\/li>\r\n<\/ul>\r\n<p><span style=\"font-weight: 400;\">There are several details and nuances associated with each of the above categories.
